Please read these terms carefully before using RigCraft

1. Acceptance of Terms

By accessing or using RigCraft ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access the Service. You must be at least 18 years old or the legal age of majority in your jurisdiction to use this Service. By using RigCraft, you represent and warrant that you meet this requirement. RigCraft reserves the right to modify these terms. Changes will be notified 30 days in advance. Continued use after changes constitutes acceptance.

2. Description of Service

RigCraft is a Software as a Service (SaaS) platform that uses artificial intelligence to generate preset configurations for digital guitar modelers. The Service allows users to: - Generate presets based on song, artist, and guitar configuration references - Store and manage a personal preset library - Manage guitar profiles to optimize recommendations - Iterate and refine existing presets Supported devices include Neural DSP Quad Cortex, Boss Waza Air, and future devices. The generated presets are ALGORITHMIC SUGGESTIONS and do not represent official, endorsed, or verified configurations by artists, equipment manufacturers, or record labels.

3. User Accounts

To use RigCraft, you must create an account providing accurate, complete, and up-to-date information. You are responsible for: - Maintaining the confidentiality of your access credentials - All activities that occur under your account - Immediately notifying any unauthorized use of your account - Keeping your profile information updated It is prohibited to: - Create more than one account per person - Share credentials with third parties - Use another person's account - Create accounts with false information RigCraft reserves the right to suspend or terminate accounts that violate these terms, without prior notice and without liability.

4. Credits System and Payments

RigCraft operates with a credit system for preset generation:

Plan Credits (Monthly)

Granted according to the subscribed plan
Reset at the start of each billing cycle
Unused credits DO NOT accumulate for the next period
Non-transferable between accounts

Bag Credits (Purchased)

Acquired through credit packs
DO NOT expire while the account remains active
Consumed AFTER monthly credits are exhausted
Non-transferable between accounts
Maximum accumulation limit: 500 credits per type

Credit types (preset and iteration) are independent and CANNOT be exchanged between each other. Each type can only be used for its specific purpose.

Credit Consumption

A preset credit is consumed when you initiate the generation of a new preset AND the system successfully completes the process (READY status).

An iteration credit is consumed when you request an improvement/modification of an existing preset AND the system successfully completes the iteration process.

If generation fails due to system error (not user error), the credit will be automatically restored within 24 hours. If the failure is due to invalid data provided by you, the credit will NOT be restored.

Billing and Payment Processing

All payments are processed through Paddle.com, which acts as Merchant of Record. Payment data is handled exclusively by Paddle; RigCraft does NOT store card numbers or banking data.

All prices are displayed in US dollars (USD). Currency conversion fees may apply.

Displayed prices do NOT include applicable taxes (VAT, GST, sales tax). Taxes will be calculated before completing the purchase.

Payment Failure Grace Period

If your payment method fails when renewing your subscription, Paddle will attempt up to 3 charges over a 7-day period. During the grace period, your access continues but monthly credits will not be granted until payment is regularized. If payment is not resolved in 7 days, your subscription will be automatically cancelled.

Plan Changes

Upgrade: Upgrade changes apply immediately with prorated billing. Unused monthly credits from the previous plan are lost.

Downgrade: Downgrade changes are scheduled for the start of the next billing period. You maintain all current plan benefits until then.

Cancellation: You can cancel at any time. Cancellation must be made at least 24 hours before renewal to avoid the next charge. Bag credits are kept for 90 days after cancellation.

Refund Policy

All payments are processed by Paddle as our Merchant of Record.

Refund requests are handled exclusively by Paddle according to their Consumer Terms. To request a refund, submit a request through Paddle or contact billing@rigcraft.app for assistance.

Chargeback Policy

A chargeback is when you dispute a charge directly with your bank instead of contacting us. If you initiate a chargeback, your account will be IMMEDIATELY suspended. If resolved in RigCraft's favor, you must pay the original amount plus administrative fees (up to $25 USD) to reactivate. Fraudulent chargebacks may result in permanent account termination and legal action. ALWAYS contact us first at billing@rigcraft.app before initiating a chargeback.

5. Artificial Intelligence Disclaimer

The presets, configurations, and recommendations provided by RigCraft are generated through artificial intelligence and machine learning algorithms.

RIGCRAFT DOES NOT GUARANTEE:

That presets will exactly replicate the tone of specific artists or songs
The technical accuracy of suggested configurations
That results will meet user expectations or preferences
Perfect compatibility with your specific equipment
That suggestions represent actual configurations used by artists

AI RESULTS MAY:

Contain inaccuracies or "hallucinations" typical of AI systems
Vary significantly from the desired reference sound
Require substantial manual adjustments by the user
Not be appropriate for all contexts or musical genres

You acknowledge and accept that presets are suggested starting points, NOT definitive configurations. It is your responsibility to verify, test, and adjust any configuration. Results depend on multiple factors outside RigCraft's control (your guitar, amplifier, strings, technique, etc.). By using RigCraft, you accept that the experimental and unpredictable nature of artificial intelligence means results may not meet your expectations, and this does NOT constitute a service defect. Refund eligibility is governed by Paddle's Consumer Terms.

6. Intellectual Property

RIGCRAFT PROPERTY

RigCraft and its licensors retain all rights, title, and interest in: the software, source code, algorithms, and AI models; the user interface, visual design, and user experience; trademarks, logos, and domain names; any improvements, modifications, or derivative works of the Service.

USER PROPERTY

You retain ownership of: presets you save in your personal library, guitar profiles you configure, any original content you upload to the Service.

LICENSE OF USE

RigCraft grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service exclusively for personal, non-commercial use, subject to these Terms.

RESTRICTIONS

You may NOT:

Reverse engineer, decompile, or disassemble the Service
Extract data through scraping, bots, or automated methods
Copy, modify, or create derivative works of the Service
Redistribute, sublicense, sell, or transfer access to the Service
Use the Service to train other AI models
Remove intellectual property or copyright notices

7. User Content

"User Content" includes saved presets, guitar profiles, preferences, and any other data you enter into the Service.

You are solely responsible for your User Content and warrant that: you have all necessary rights to said content, it does not infringe third-party rights, it does not contain illegal, offensive, or harmful material.

By uploading User Content, you grant RigCraft a worldwide, non-exclusive, royalty-free license to: store, process, and display your content in the Service, create technical backups, analyze usage data in aggregate and anonymous form to improve the Service. This license does NOT allow RigCraft to: sell your User Content to third parties, use your presets for commercial purposes without consent, share your content publicly without authorization.

RigCraft may delete User Content that violates these terms. It is your responsibility to maintain backup copies of your important content. RigCraft does not guarantee recovery of lost content.

8. Acceptable Use Policy

PERMITTED USE

Personal use to create and manage guitar presets
Experimentation and learning about tone configuration
Use as a support tool in personal music production

PROHIBITED USE

Service Abuse:

Using bots, scripts, or automation to generate presets massively
Attempting to evade credit limits or system restrictions
Intentionally overloading servers or infrastructure
Attempting to access restricted areas or other users' accounts

Unauthorized Commercial Use:

Reselling or redistributing presets generated by RigCraft
Offering preset creation services using RigCraft for third parties
Using the Service as part of a commercial product without license

Security:

Attempting to hack or compromise the Service
Distributing malware, viruses, or malicious code
Collecting information from other users without consent

Violations may result in: formal warning, temporary account suspension, permanent account termination, legal action if applicable.

9. Third-Party Rights and Trademarks

RigCraft allows users to search and generate presets using artist names, songs, albums, and musical equipment as reference. The use of these names is EXCLUSIVELY REFERENTIAL and descriptive, with the purpose of helping users communicate the type of sound they seek to achieve.

RIGCRAFT IS NOT: affiliated, associated with, or sponsored by any artist, band, record label, or equipment manufacturer mentioned; does not own or claim rights to third-party trademarks; does not guarantee that presets replicate actual artist configurations; does not have endorsement or approval from artists or rights holders.

"Quad Cortex" and "Neural DSP" are registered trademarks of Neural DSP Technologies. "Waza Air" and "Boss" are registered trademarks of Roland Corporation. All artist, band, and song names are property of their respective owners. These marks are used solely to identify device compatibility and sound references under fair use nominative principles. RigCraft is an independent product and is not endorsed, certified, or approved by any of these trademark holders.

10. Limitation of Liability

MONETARY LIMIT

RigCraft's total cumulative liability for any claim related to these Terms or the Service shall not exceed the greater of: (a) amounts paid by you to RigCraft in the 12 months prior to the event giving rise to the claim, or (b) one hundred US dollars ($100 USD).

EXCLUSION OF DAMAGES

RigCraft shall NOT be liable for any: indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, use, or goodwill; cost of obtaining substitute services; damage resulting from unauthorized access to your data, service interruption, viruses or malicious code, errors or omissions in content, third-party conduct, or any other matter related to the Service.

These limitations apply regardless of legal theory (contract, tort, negligence, strict liability, or otherwise) and even if RigCraft has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In such cases, the above limitations shall apply to the maximum extent permitted by law.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

RIGCRAFT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING:

Implied warranties of merchantability
Warranties of fitness for a particular purpose
Warranties of non-infringement
Warranties that the Service will be uninterrupted, timely, secure, or error-free
Warranties that results obtained will be accurate or reliable
Warranties that the quality of presets will meet your expectations

RIGCRAFT DOES NOT GUARANTEE: continuous availability of the Service (maintenance, updates, or interruptions may occur), compatibility with all devices, browsers, or systems, that defects will be corrected, that the Service is free of viruses or harmful components, the security of information transmitted to or from the Service. You use the Service at your own risk and discretion.

12. Indemnification

You agree to defend, indemnify, and hold harmless RigCraft, its directors, officers, employees, agents, licensors, and service providers from and against any claim, liability, damage, judgment, award, loss, cost, expense, or fee (including reasonable attorneys' fees) arising out of or related to: - Your violation of these Terms and Conditions - Your use of the Service in violation of these Terms - Your violation of any applicable law or regulation - Your violation of third-party rights, including intellectual property rights - Any content you upload, post, or transmit through the Service - Your negligence or willful misconduct

RigCraft will promptly notify you of any claim covered by this indemnification and will reasonably cooperate in your defense. You may not agree to any settlement that imposes obligations on RigCraft without its prior written consent.

13. Termination

BY THE USER

You may cancel your account at any time from your profile settings or by contacting support. Cancellation will be effective at the end of your current billing period.

BY RIGCRAFT

RigCraft may suspend or terminate your access to the Service, without prior notice and without liability, for any reason, including: violation of these Terms, conduct that RigCraft considers harmful to other users or the Service, request from legal authorities, discontinuation of the Service, unexpected technical or security issues.

EFFECTS OF TERMINATION

You will lose immediate access to the Service
Unused credits (monthly and bag) will be forfeited
Your User Content may be deleted after 30 days
Refund eligibility is determined according to Paddle's Consumer Terms

INACTIVE ACCOUNTS

If your account remains inactive (no login or service use) for more than 12 consecutive months, you will receive an email notice 30 days before any action. RigCraft may delete your User Content and bag credits. To avoid deletion, simply log in before the 30-day notice period expires. Accounts with active subscriptions are never considered inactive.

MINORS

RigCraft is NOT directed at persons under 18 years of age. If we discover that a minor has created an account, the account will be terminated immediately without notice, no refunds will be granted, all User Content will be deleted, and personal data will be deleted according to applicable regulations (COPPA, GDPR-K, or other child protection laws).

The following sections survive termination: Intellectual Property, Limitation of Liability, Disclaimer of Warranties, Indemnification, Dispute Resolution, and any other provision that by its nature should survive.

14. Dispute Resolution

GOVERNING LAW

These Terms are governed by the laws of the Republic of Chile, without regard to its conflict of laws principles.

MANDATORY ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules in effect. Arbitration will be conducted in Santiago, Chile, in Spanish. The arbitrator's decision will be final and binding.

CLASS ACTION WAIVER

YOU AND RIGCRAFT AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims from more than one person nor preside over any type of class or representative proceeding.

OPT-OUT RIGHT

You may opt out of this arbitration clause by sending written notice to legal@rigcraft.app within 30 days following the creation of your account. The notice must include your name, address, account email, and clear statement that you wish to opt out of arbitration.

Notwithstanding the above, either party may: seek injunctive relief in competent courts to protect intellectual property rights, or bring claims in small claims courts if they qualify.

15. Privacy

Your privacy is important to us. Use of the Service is subject to our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using RigCraft, you consent to: the collection and use of information according to our Privacy Policy, data processing necessary to provide the Service, receiving communications related to your account and the Service.

16. General Provisions

SEVERABILITY

If any provision of these Terms is declared invalid, illegal, or unenforceable by a competent court, that provision shall be modified to achieve its original intent to the greatest extent possible, and the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other legal notices posted on the Service, constitute the entire agreement between you and RigCraft regarding the Service, and supersede any prior agreement.

NO WAIVER

RigCraft's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

ASSIGNMENT

You may not assign or transfer these Terms or your rights hereunder without RigCraft's prior written consent. RigCraft may assign these Terms without restriction.

HEADINGS

Section headings are included for convenience only and have no legal or contractual effect.

LANGUAGE

In case of conflict between versions in different languages of these Terms, the Spanish version shall prevail.

RigCraft may send notices through general announcements on the Service, email to your registered address, or written communication sent by certified mail. You may send notices to RigCraft at the contact address indicated below.
